1. Agreement

These Terms and Conditions govern your use of dellisantidesign.com and any purchase you make through it. The site is operated by Dellisanti Design Center Center Center, referred to here as we, us or our. By browsing the site or placing an order you accept these terms. If you do not accept them, please do not use the site.

2. Eligibility

You must be at least 18 years old, or the age of majority in your state, to place an order. By ordering you confirm you are legally able to enter a binding contract and that the information you give us is accurate and complete.

3. Products, descriptions and images

We describe every product as accurately as we can, including dimensions, materials and what is in the box. Product photographs are supplied by our manufacturers. Colours can vary between screens, and staging props shown in a photograph are not included unless the description says so. Always check the stated dimensions before buying, particularly for furniture.

Availability is not guaranteed until an order is accepted. If an item sells out after you order, we will contact you and refund that item in full.

4. Pricing and errors

All prices are listed in United States dollars and exclude sales tax and shipping unless stated otherwise. We may change prices at any time, but a change never affects an order we have already accepted.

Despite our care, a product may occasionally be listed at an incorrect price or with an incorrect description. Where an error is obvious and could reasonably have been recognised as a mistake, we may cancel the order and refund you in full, even after payment has been taken. We will always contact you first and give you the choice to reconfirm at the correct price.

5. Orders and acceptance

Placing an order is an offer to buy. The automatic email you receive confirms we have your order, but it is not acceptance. A contract is formed only when we dispatch the goods and send you the dispatch email. We may decline an order where the item is unavailable, where we cannot obtain payment authorisation, where we suspect fraud, or where there has been a pricing or description error.

6. Payment terms and billing

We accept the payment methods displayed at checkout, which currently include major credit and debit cards and the digital wallets shown on the payment step. Payment is taken in full at the time you place your order. No order is dispatched until payment has cleared.

By submitting payment details you confirm that you are the authorised holder of the card or account, and that there are sufficient funds to cover the charge. All payments are processed by PCI compliant third party payment providers. We do not receive, handle or store your full card number, and nothing about your card is kept on our servers.

The charge on your statement will appear under Dellisanti Design Center Center. Sales tax is calculated at checkout based on your delivery address and is shown before you confirm payment. If a payment is declined, reversed or charged back, we may suspend or cancel the order and any related account.

7. Shipping, delivery and risk

Delivery estimates, costs and methods are set out in our Shipping and Delivery Policy, which forms part of these terms. Risk of loss and damage passes to you when the goods are delivered to the address you gave us. Delivery estimates are estimates and not guarantees.

8. Returns, refunds and cancellation

Your right to return an item, the 30 day window, who pays return shipping, and how refunds are issued are set out in full in our Return and Refund Policy, which also forms part of these terms.

9. Your account

If you create an account you are responsible for keeping your password confidential and for everything done under your login. Tell us immediately if you believe your account has been used without your permission. We may suspend or close an account that is being used for fraud, abuse or any breach of these terms.

10. Acceptable use

You agree not to use this site to break any law, to interfere with its security or operation, to scrape or harvest data by automated means, to upload malicious code, to impersonate anyone, or to infringe anyone else rights. We may restrict access where any of that happens.

11. Intellectual property

The site design, text, graphics, logos and the arrangement of all of it belong to Dellisanti Design or our licensors and are protected by copyright and trade mark law. You may view and print pages for your own personal, non commercial use. You may not copy, republish or use our content commercially without written permission.

12. Reviews and submissions

If you post a review, comment or photograph, you keep ownership of it but grant us a non exclusive, royalty free, worldwide licence to use it in connection with the site and our marketing. Do not post anything unlawful, defamatory or misleading, and do not post about a product you have not bought. We may remove content that breaks these rules.

13. Third party links

Our site may link to sites we do not control. We are not responsible for their content, products or privacy practices, and a link is not an endorsement.

14. Disclaimer of warranties

The site is provided on an as is and as available basis. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non infringement. We do not warrant that the site will be uninterrupted, secure or free of errors. Nothing here limits any manufacturer warranty supplied with a product, or any right you have under applicable consumer protection law that cannot be excluded.

15. Limitation of liability

To the fullest extent permitted by law, Dellisanti Design Center and its officers, employees and suppliers are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of the site or any product bought through it. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Some states do not allow these limitations, so parts of this section may not apply to you.

16. Indemnity

You agree to indemnify Dellisanti Design against any claim, loss or expense, including reasonable legal fees, arising from your breach of these terms or your misuse of the site.

17. Product safety and assembly

Storage furniture must be assembled exactly as instructed and, where a wall anchor or anti tip fitting is supplied, it must be fitted before use. Do not exceed a stated weight limit. We are not liable for injury or damage caused by incorrect assembly, missing anchoring, or use beyond what a product is designed for.

18. Force majeure

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, carrier failures, strikes, war, epidemics and government action.

19. Governing law

These terms are governed by the laws of the State of Ohio and the federal laws of the United States, without regard to conflict of law rules. Any dispute will be brought in the state or federal courts located in Ohio, and you consent to their jurisdiction.

20. Severability and waiver

If any provision of these terms is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it.

21. Changes to these terms

We may update these terms at any time. The version in force is the one published on this page at the moment you place your order, and the date at the top tells you when it last changed. Continuing to use the site after a change means you accept the updated terms.
