These Terms and Conditions ("Terms") govern your access to and use of the Dellisanti Design Center website located at http://dellisantidesign.com (the "Website") and all purchases made through it. By browsing the Website or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms.

Our Website is intended for personal, non-commercial use by consumers located in the United States. Use of this Website for any unlawful purpose or in any manner inconsistent with these Terms is strictly prohibited.

We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting to the Website. Continued use of the Website following any update constitutes your acceptance of the revised Terms.

 

Product listings displayed on our Website are invitations to purchase and do not constitute legally binding offers. By submitting an order, you are making an offer to purchase the selected items subject to these Terms.

A binding purchase contract between you and Dellisanti Design Center is formed only when we send you an official order confirmation email. Until that confirmation is issued, no contract exists, and we are not obligated to fulfill the order.

We reserve the right to refuse or cancel any order at our sole discretion, including but not limited to situations involving:

•       Pricing errors or inaccuracies on the Website

•       Suspected fraudulent or unauthorized transactions

•       Products that are out of stock or discontinued

•       Failure to meet eligibility requirements

•       Errors in product descriptions or specifications

If your order is cancelled after payment has been processed, you will receive a full refund using the original payment method. All communications related to your order will be conducted in English.

 

All prices displayed on our Website are in United States Dollars (USD) and are subject to change without notice. Price changes do not affect orders for which a confirmation email has already been issued.

Applicable sales tax will be calculated and applied at checkout based on your shipping address and the tax laws of the applicable state. The final tax amount will be clearly shown before you complete your purchase.

We make every effort to ensure pricing accuracy. In the event of a clear pricing error, we reserve the right to cancel the order and notify you before processing, giving you the opportunity to reorder at the correct price.

 

Full payment is required at the time of checkout. We accept the following payment methods:

All transactions are processed securely. We do not store your full payment card details on our systems. By submitting payment, you confirm that you are authorized to use the selected payment method and that the information provided is accurate.

Orders will not be processed or shipped until payment has been successfully verified.

 

We currently ship to addresses within the contiguous United States only. We do not ship internationally or to U.S. territories at this time.

Orders are typically dispatched within 1–3 business days of order confirmation. Estimated delivery timeframes are 3–7 business days from the date of confirmation, depending on your location and product availability.

Delivery estimates are provided for guidance only and are not guaranteed. Delays may occur due to carrier issues, weather conditions, customs procedures, or circumstances beyond our control. We are not liable for delivery delays outside our reasonable control.

Due to the nature of furniture items — which may be large, heavy, or require special handling — some orders may be subject to freight or white-glove delivery arrangements. Any applicable delivery options and associated costs will be clearly communicated at checkout or prior to shipment.

Risk of loss and title to the products pass to you upon delivery to the address specified in your order. If you believe your shipment is lost or damaged in transit, please contact us as soon as possible so we can assist in resolving the matter.

We may ship orders in multiple partial shipments where items are fulfilled from different locations or become available at different times. Each partial shipment will be separately confirmed.

 

All products remain the property of Dellisanti Design Center until full and clear payment has been received and confirmed. We reserve the right to reclaim goods in the event of a payment reversal or dispute, to the extent permitted by applicable law.

 

Our return and refund procedures are governed by our separate Return & Refund Policy, which is available on our Website. We encourage you to review this policy before making a purchase, as it contains important information about eligibility, timeframes, and the return process.

The Return & Refund Policy forms part of these Terms and is incorporated herein by reference. In the event of any conflict between these Terms and the Return & Refund Policy on matters relating to returns, the Return & Refund Policy shall prevail.

 

We stand behind the quality of our furniture products. Nothing in these Terms limits or excludes any rights you have under applicable U.S. consumer protection laws, including any implied warranties that cannot lawfully be excluded.

If a product you receive is defective, damaged, or materially different from what was described at the time of purchase, you may be entitled to a repair, replacement, or refund, as appropriate under the circumstances.

Where legally permitted, we reserve the right to first attempt to repair or replace a defective item before issuing a refund. We will work with you in good faith to resolve any product quality issues promptly.

Any manufacturer warranties provided with specific products are separate from and in addition to your statutory rights. Details of such warranties, where applicable, will be included with the product or made available upon request.

These Terms do not affect your statutory rights as a consumer under applicable federal and state law.

 

To the fullest extent permitted by applicable law, Dellisanti Design Center's total liability to you for any claims arising out of or related to your use of the Website or purchase of products shall not exceed the total amount you paid for the specific order giving rise to the claim.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or loss of use, to the extent permitted by law.

Nothing in these Terms limits or excludes our liability for:

•       Personal injury or death caused by our negligence

•       Fraud or fraudulent misrepresentation

•       Willful misconduct or gross negligence

•       Any other liability that cannot be excluded or limited under applicable law

Some states do not allow the limitation of certain damages, so some of the above limitations may not apply to you.

Governing Process

If a dispute cannot be resolved informally, you and Dellisanti Design Center agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or your purchase through binding arbitration conducted by a neutral arbitrator, rather than in court, except as set forth below.

The arbitration shall be conducted under the rules of the American Arbitration Association (AAA) or a similar recognized arbitration body. The arbitration will take place in Ohio, or may be conducted remotely if mutually agreed.

Exceptions

Either party may seek relief in small claims court for disputes within the jurisdictional limits of that court. Either party may also seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.

Class Action Waiver

To the extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, collective, or representative action. If this waiver is found to be unenforceable, the arbitration agreement shall not apply to that claim.

 

These Terms and any disputes arising out of or related to them shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law principles.

Applicable federal laws of the United States shall also apply where relevant, including but not limited to federal consumer protection regulations and electronic commerce laws.

 

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms.

The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision, and the remaining Terms shall continue in full force and effect. Any severed provision shall be replaced by a valid provision that most closely reflects the original intent of the parties.
